  • Using AI-generated content can entail legal risks. It is possible that content infringes the rights of third parties, such as copyrights. This could be the case, for example, if an AI-generated image bears too strong a resemblance to a protected creation. Therefore, exercise caution when prompting, read the terms and conditions of the relevant AI tool and, in case of doubt, have the content legally reviewed before use.

  • The most obvious route is to approach the person who posted the unlawful publication. However, you can (in addition) also approach the platform that facilitates the content. Good to know is that platforms have recently, in principle, been required to use a notice-and-takedown procedure. This means that you must be able to report the unlawful publication to a platform and they are obliged to assess it. If the platform refuses to remove the content, there are other legal options to still get the content removed. We are happy to help you.

  • The use of GenAI for content creation is relatively new and not without legal risk. It is therefore important that you make clear agreements about this with the advertising agency. For example, you can allow or ban the use of specific tools, coordinate the necessary security measures, and agree on which responsibilities the advertising agency will assume and which risk your business may have to bear itself.
